We represent creditors and trustees in contested bankruptcy matters, including suits to challenge discharge or dischargeability, avoidance and preference actions, and fraudulent transfer litigation. Among the creditors we represent in bankruptcy are banks and other commercial lenders, commercial landlords, material suppliers, equipment-rental firms, design professionals, contractors, and construction trades.
COMMERCIAL COLLECTIONS AND CONSTRUCTION LIENS
We represent commercial lenders and landlords, material suppliers, equipment-rental firms, design professionals, contractors, and construction trades in collecting balances owed, including though liens on funds, liens on real estate, and bond claims. We are familiar with the Miller Act and bonded public projects. Our attorneys have perfected liens against real property and sold that property when necessary to get a client paid. However, our focus is on getting our clients paid as efficiently as possible, which sometimes means working behind the scenes and filing nothing.

We represent commercial landlords in enforcing their rights, including through eviction.
FRAUD RECOVERY
We have the experience to recover funds lost through Ponzi schemes, investment scams, and other forms of fraud, financial elder abuse; and employee theft and embezzlement. We have helped clients injured by embezzlement recover both through insurance and pursuit of the perpetrator and other beneficiaries. We have found that recovering funds lost through fraud often requires acting quickly and using emergency procedures, including pre-judgment attachment. Waiting on the criminal justice system, or filing an ordinary lawsuit, is rarely advisable.
JUDGMENT ENFORCEMENT
We represent creditors of all types in collecting significant civil judgments, including judgments from foreign states that need to be domesticated to North Carolina. We have experience finding concealed and transferred assets, untitled equipment, and assets held by affiliated trusts and corporate entities.
